Terms and Conditions

§ 1 Scope

These Terms and Conditions apply to all buying transactions between Till Schwalenberg, Ohmstraße 8, 24537 Neumünster (the "Buyer") and the selling party (the "Customer") via the website matrastcg.de.

The Customer accepts these Terms by submitting the contact form or confirming an offer.

(EU restriction) Buying is only possible for customers with their residence and shipping address within the European Union. Shipments from non-EU countries (e.g. the United Kingdom, Switzerland, USA) are not accepted, due to the associated customs and import formalities and costs.

(Language) Communication, including emails and the offer page, takes place in the chosen customer language (German or English). Each collection is assigned a customer language; for enquiries via the website it is determined by the language version used (DE/EN).

§ 2 Subject of the contract

The Buyer purchases used and new trading cards from the games Yu-Gi-Oh!, Magic: The Gathering and Pokémon. For Pokémon, sealed products and graded cards (slabs) are also bought. Accessories (sleeves, binders, deck boxes, etc.) are not bought but may be included as packaging material.

§ 3 Conclusion of the contract

(1) The Customer submits a non-binding buying enquiry via the contact form on matrastcg.de or by email.

(2) After receiving and reviewing the collection, the Buyer prepares an individual offer. This is made available to the Customer via a password-protected online listing.

(3) The purchase contract is concluded only upon the Customer's express confirmation of the offer on the online listing. The time of electronic confirmation is decisive.

(4) Until confirmation, the Customer may request the return of the entire collection.

(5) The Customer may exclude individual cards from acceptance and request their return (partial acceptance). Unconfirmed cards remain the property of the Customer and are returned.

(6) The offer is valid for 30 days from creation. If the Customer neither accepts nor declines within this period, the offer lapses and the collection is returned to the Customer (free of charge within Germany; return postage outside Germany at the Customer's cost). The Customer is reminded of the pending offer by email during this period.

(7) A partial acceptance in which only bulk cards are sold and all individually valued cards are reclaimed is not possible.

(8) The Customer must be at least 18 years old or have the consent of a legal guardian.

(9) The Customer warrants that they own the cards sent in or are authorised to sell them.

§ 4 Prices and payment

(1) Buying prices are based on the current Cardmarket minimum price (the lowest offer from a German seller on cardmarket.com in the relevant language and condition) at the time of valuation. For graded cards (slabs) and sealed products, the market value may also be determined using other current market data, such as recently achieved sale prices.

(2) A buying percentage, depending on the card value, is deducted from the minimum price. The current percentages can be viewed on the website.

(3) Cards below the bulk threshold are valued at a flat rate by rarity and quantity. The bulk prices can be viewed on the website.

(4) Payment is made after confirmation of the offer via PayPal or bank transfer (within the EU by SEPA transfer) in euros within 5 business days of offer confirmation. The Customer provides the payment details when confirming the offer. Any fees for an international transfer are borne by the Customer.

(5) In the case of obvious pricing errors (e.g. due to faulty market data), the Buyer reserves the right to correct the offer and submit an adjusted offer to the Customer.

§ 5 Transfer of ownership

(1) Ownership of the cards passes to the Buyer only upon full payment of the buying price.

(2) Until the Customer confirms the offer, all cards remain the property of the Customer.

§ 6 Shipping and packaging

(1) Shipping of the collection to the Buyer is generally at the Customer's cost.

(2) From an estimated collection value of 50 €, the Buyer provides the Customer with a link to create a free DHL shipping label. The Customer creates the label themselves via the DHL returns page, entering their sender address and the collection number provided by the Buyer as the customer reference. This free label is available within Germany only.

(3) The label link may only be used for the specific collection for which it was provided. If a Customer creates a shipping label without prior authorisation from the Buyer (e.g. for a collection below the threshold or for an unregistered shipment), the resulting label and shipping costs are deducted from the payout amount.

(4) The Customer is responsible for proper packaging. Packaging instructions can be found in the packaging guide.

(5) When using the shipping label provided by the Buyer, the Buyer bears the shipping risk. For self-organised shipping, the Customer bears the shipping risk until the cards arrive at the Buyer.

(6) The free shipping label is limited to shipments within Germany. For customers elsewhere in the EU, no free shipping label is provided; shipping to the Buyer is at the Customer's cost and risk (recommended: tracked and insured).

§ 7 Returns

(1) If the Customer fully declines the offer, all cards are returned by insured shipping (free of charge within Germany).

(2) For partial acceptance: return of the unsold cards is free from a return value of 20 €. Below that, shipping costs of 3.69 € (DHL small parcel) apply and are deducted from the payout amount.

(3) Bulk cards cannot be reclaimed individually in a partial acceptance.

(4) Free return applies to addresses within Germany. Returns to other EU countries are at the Customer's cost; the amount of the return costs is communicated to the Customer in advance and may be deducted from the payout amount or invoiced separately.

§ 8 Right of withdrawal

(1) As this is a purchase of used goods from the Customer (consumer) and not a sale to the Customer, there is no statutory right of withdrawal within the meaning of §§ 312g, 355 of the German Civil Code (BGB).

(2) However, the Customer may request the return of their cards at any time until the offer is confirmed.

§ 9 Condition assessment

(1) The condition of the cards is assessed according to the official Cardmarket condition guidelines.

(2) The condition on arrival of the cards at the Buyer is decisive.

(3) Cards with tears, separated layers, lamination, mould or other damage that precludes resale are not counted.

§ 10 Liability

(1) The Buyer is liable without limitation for intent and gross negligence.

(2) In the case of slight negligence, the Buyer is liable only for breach of essential contractual obligations (cardinal obligations). In that case, liability is limited to the foreseeable damage typical for this type of contract.

(3) Liability for damage to life, body and health remains unaffected.

§ 11 Data protection

Information on the processing of personal data can be found in the privacy policy.

§ 12 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) If the Customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Neumünster. For consumers, the statutory place of jurisdiction applies.

(3) Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. The statutory provision takes the place of the invalid provision.

(4) For consumers resident in another EU member state, the mandatory consumer protection provisions of their country of residence remain unaffected despite the choice of law (Art. 6 Rome I Regulation).

§ 13 Online dispute resolution

The EU Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. The Buyer is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
